Fathers in Switzerland Get Equal Rights

The Swiss government has decided separated parents should automatically have joint custody of their children except in cases involving the specific protection of the child.

When a couple splits or gets divorced, custody of their children will be shared without the need for a prior agreement or the approval of a judge.

Justice Minister Simonetta Sommaruga said on Thursday that the Federal Council considered the move obvious, since a child has the right to build an autonomous relationship with both father and mother.

All political parties, as well as fathers’ and men’s associations, welcomed Sommaruga’s proposal, which is widely expected top pass into law when voted on in parliament in the coming weeks.

But while joint custody is set to become the norm, a judge will still have to sign off on the suitability of both parents to take responsibility for their children. A parent may be denied custody for reasons including infirmity, a history of violence or absence.

Currently, when a couple divorces, one parent generally gets sole custody. If the couple is not married, the mother is the legal custodian. For now, joint custody is only possible if both parties sign an agreement on how they plan to distribute and share alimony and childcare.

The draft proposal also regulates the question of residency. If a parent wishes to move, either alone or with the child, he or she will need the consent of the other party. If there is no agreement, a judge will have to intervene to protect the well-being of the child.

Every year, about 14,000 children in Swizerland are confronted with their parents’ divorce or separation.

This petition has been started by a british MP and it supports the need for a change in family law so that fathers are given parenting rights after separation or divorce.

Under current UK law, fathers are in many cases left without access to their children when the mother denies contact or uses parental alienation to form a rift between the father and their child.

Christmas Is A Sad Time For Many UK Fathers

Fathers Rights is a campaign group that is battling to change family laws in the UK, so that children are protected from child abuse being carried out by thousands of resident parents in the UK.

Most people do not realise that, if a resident parent (usually the mother) denies contact to your children, there is nothing that can be done in current UK law, except for months in court before you get contact restored. The sad reality is that the court cases can continue for many years, cost tens to hundreds of thousands of pounds, reduce fathers to devestated individuals and worst of all, the children are left dealing with situations and emotions that can effect them negatively in later life.

Alienating dads from their own children is a form of child abuse and needs to be stamped out by introducing changes in the law that will stop alienation being carried out and help to protect the children, who are the innocent victims in these cases.

The UK signed up to the United Nations Convention On The Rights Of A Child but is failing to adhere to these rights, making children and fathers suffer needlessly.

Spare a thought for millions of fathers and children this Christmas who will be victims of alienation and be left dealing with unnecessary pain and suffering.
